Q: Do I qualify for a fiance visa?

A: Generally, if you have met your fiance in person within the last 2 years, make over the Poverty Guidelines of $18,212, and there is a real, bona-fide relationship, then you qualify.

Q: Do I qualify for a marriage visa?

A: If you have married a foreign national, make over the Poverty Guidelines of $18,212, and there is a real, bona-fide relationship, then you qualify.

Q: What is the difference between a fiancee visa (K1) and marriage visa (K3)?

A: A K1 Visa is a fiance visa. It is for those who have met in person within the last 2 years and plan on marrying once fiancee enter U.S. A K3 Visa is for those who are already married and allows the Spouse to legally enter and reside in the U.S.

Q: How long does it take to get Fiancee/Spouse to the U.S.?

A: For K1 fiance visas the wait times from start to finish is typically between 3-7 months. This is from submission of packet to USCIS to the time fiancee actually gets the fiance visa in her hand. Don't be fooled by Law Firms or "Certified Immigration Consultants" promising shorter wait times. For K-3 marriage visas, the processing time is typically between 6-12 months. The main benefit of the K3 spousal visa is that once here, your spouse does not have to file for an Adjustment of Status like a fiancee would.


Q: Can your Law Firm speed up the fiance visa or marriage visa process?

A: The USCIS processes all fiance visa and marriage visa petitions in order. Realistically, there is no way to speed up process. The key is to submitting a CORRECTLY completed packet to avoid delays.


Q: What are the TOTAL GOVERNMENT FEES involved for a K1 fiance visa?

A: Besides our fee, the USCIS charges a petition fee of $340. Once the approved fiance visa petition gets the fiancee's embassy, they will contact your fiancee to have fiancee set up a medical exam and interview. Most embassies charge $350 for the fiance visa issuance fee and $200 for the medical exam. An honest estimate of total USCIS/government fees is around $890.

Q: What are the TOTAL GOVERNMENT FEES involved for a K3 marriage visa?

A: Besides our fee, the USCIS charges a marriage visa petition fee of $420. Once the approved marriage visa Petition gets to Spouse's embassy, they will contact your Spouse to have Spouse set up a medical exam and interview.  Most embassies charge $350 for the visa issuance fee and $200 for the medical exam. An honest estimate of total USCIS/government fees is around $970.

Q: Can fiancee's child(ren) come over also on the fiance visa and do you charge for this?

A: Yes! Children under 18 can accompany Fiancee/Spouse to the U.S. For a K1, fiance visa, this is called a K2 Visa. We do not charge you for adding them to paperwork.
